1. Agreement to terms

These Terms of Service (the "Terms") govern your access to and use of the website operated at ebctel.com (the "Site"), provided by Enhanced Business Communications LLC, a Michigan limited liability company ("EBC," "we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree, please do not use the Site.

2. About EBC and the scope of these Terms

The Site is informational. It describes EBC's services, publishes a technical reference library, and provides contact channels for prospective and existing clients.

These Terms apply to your use of the Site only. EBC's actual telecom, unified communications, and contact center services — when delivered — are governed by separate written agreements between EBC and the engaging client (Master Service Agreements, Statements of Work, deployment orders, support agreements, or similar). Nothing on the Site, in the Library, or in pre-sales correspondence creates a service agreement, warranty, or obligation by EBC except as set out in a separately signed agreement.

3. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Site or to any system or network connected to it.
• Probe, scan, or test the vulnerability of the Site, except as expressly authorized by EBC in writing.
• Introduce viruses, worms, or any other malicious code.
• Interfere with the operation of the Site or with another visitor's enjoyment of it.
• Scrape, crawl, or harvest content from the Site at a rate or volume that constitutes an abuse of resources, or to build a competing product.
• Misrepresent your identity or affiliation when contacting EBC through the Site.

4. Intellectual property

The Site, its design, the text and graphical content of the Site, the Library articles, and the EBC name and brand are the property of Enhanced Business Communications LLC or its licensors and are protected by United States and international intellectual-property law.

You may view, save, and print individual pages of the Library for personal or internal business reference. You may not republish, redistribute, or create derivative works from Library content without prior written permission. You may quote brief excerpts (under 200 words) with attribution to EBC and a link to the original page.

5. Disclaimer of warranties

The Site and all content on it are provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

The Library is published as a record of practitioner experience. It is not professional advice. It is not a substitute for engagement with a qualified telecommunications consultant for the specifics of your environment. EBC makes no representation that the patterns, examples, or guidance described in any Library article will produce any particular outcome in any particular deployment.

6. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall EBC, its members, officers, employees, or agents be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site or any content on it, even if EBC has been advised of the possibility of such damages.

EBC's total cumulative liability arising out of or relating to the Site shall not exceed one hundred United States dollars (US $100). This limitation applies whether the claim is based on contract, tort, statute, or any other legal theory.

This limitation does not apply to liability that cannot be excluded under applicable law, and it does not limit any obligation that EBC may have to you under a separately signed services agreement.

7. Indemnification

You agree to indemnify and hold harmless EBC from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your unlawful use of the Site.

8. External links

The Site may contain links to websites or resources that are not operated by EBC. EBC does not control and is not responsible for the content, policies, or practices of any third-party site. Following an external link is at your own risk.

9. Privacy

Your use of the Site is also governed by the Privacy Policy and the Cookie Policy, which are incorporated into these Terms by reference.

10. Governing law and venue

These Terms are governed by and construed in accordance with the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or to the Site shall be the state or federal courts located in Wayne County, Michigan, and each party consents to the personal jurisdiction of those courts.

If you are a consumer in a jurisdiction whose law mandates a different governing law or venue, that mandatory provision applies to the extent required.

11. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted on the Site. Continued use of the Site after a revision constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
